1. Acceptance of Terms
By creating an account or using SocialEnrich ("Service"), you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time with 30 days' notice via email or in-app notification.
2. Description of Service
SocialEnrich provides a social data enrichment platform that enables users to:
- Enrich contact records with social intelligence and behavioral data
- Access B2B and B2C contact databases via API and dashboard
- Integrate enrichment capabilities through our REST API and MCP Server
- Analyze social profiles and behavioral patterns for business intelligence
3. Account Registration & Security
- You must provide accurate, complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials and API keys.
- You must notify us immediately of any unauthorized use of your account.
- One person or legal entity may maintain only one free account.
- You must be at least 18 years old to use the Service.
4. Acceptable Use
You agree to use the Service in compliance with all applicable laws and our Acceptable Use Policy. Prohibited uses include but are not limited to:
- Scraping, reselling, or redistributing enriched data without authorization
- Using data for unsolicited bulk communications (spam)
- Attempting to reverse-engineer, decompile, or access our proprietary algorithms
- Circumventing rate limits, usage quotas, or security measures
- Using the Service for any illegal, harmful, or discriminatory purpose
- Sharing API keys or credentials with unauthorized third parties
5. Subscription & Billing
5.1 Plans & Credits
- The Service offers free and paid subscription plans with varying credit allotments.
- Credits are consumed per enrichment request as defined in your plan documentation.
- Unused credits expire at the end of each billing cycle unless otherwise specified.
5.2 Payment
- Paid plans are billed in advance on a monthly or annual basis via Stripe.
- All fees are non-refundable except as expressly stated in Section 5.4.
- Prices are listed in USD and exclude applicable taxes.
5.3 Upgrades & Downgrades
- Plan changes take effect at the next billing cycle.
- Upgrading mid-cycle will be prorated. Downgrading mid-cycle takes effect at renewal.
5.4 Refunds
Annual plans may be refunded within 14 days of initial purchase if fewer than 50 credits have been used. Monthly plans are non-refundable.
6. Intellectual Property
- Our IP: The Service, including its design, algorithms, documentation, and branding, is owned by SocialEnrich and protected by intellectual property laws.
- Your Data: You retain all rights to data you upload to the Service. You grant us a limited license to process your data solely to provide the Service.
- Enrichment Output: Enriched data returned by the Service may be used by you in accordance with these Terms and applicable data protection laws.
- Feedback: Any feedback, suggestions, or ideas you provide may be used by us without obligation or compensation.
7. API Terms
- API access is subject to rate limits defined in your subscription plan.
- We reserve the right to throttle or suspend API access for abuse or excessive usage.
- API responses must not be cached for more than 90 days without explicit permission.
- You must not use our API to build a competing enrichment service.
- API documentation at developers.socialenrich.net is part of these Terms.
8. Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws (GDPR, CCPA, PDPA Vietnam).

9. Service Level & Availability
- We target 99.9% uptime for the API and dashboard (excluding scheduled maintenance).
- Scheduled maintenance windows are communicated at least 48 hours in advance.
- Real-time status is available at status.socialenrich.net.
- Enterprise SLA agreements are available on request for Business and Enterprise plans.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
- We do not guarantee the accuracy, completeness, or timeliness of enrichment data.
- Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
- We shall not be liable for indirect, incidental, special, consequential, or punitive damages.
11. Termination
- By You: You may cancel your account at any time through the dashboard or by contacting support.
- By Us: We may suspend or terminate your account for breach of these Terms, non-payment, or illegal activity with reasonable notice.
- Effect: Upon termination, your access ceases immediately. We retain your data for 30 days, after which it is permanently deleted.
- Data Export: You may request a data export within 30 days of termination.
12. Governing Law & Disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict of law principles.
Any disputes shall be resolved through good-faith negotiation first, then binding arbitration in Ho Chi Minh City, Vietnam, under the rules of the Vietnam International Arbitration Centre (VIAC).
